Varmyra Terms of Service

These Terms of Service govern your use of the Varmyra website and your purchase of products and services from Varmyra. By accessing our website or placing an order, you agree to these Terms of Service.
1. About Varmyra
Varmyra is a general partnership based in Ottawa, Ontario, Canada. Varmyra creates personalized, made-to-order, custom, and other designed products including signs, décor, gifts, keepsakes, pet products, business products, and other personalized items.
2. Website Use
You agree to use our website lawfully and not to:
- Violate applicable laws
- Attempt to interfere with website security or operation
- Use the website for fraudulent purposes
- Copy or misuse Varmyra content without permission
- Submit false, misleading, or unauthorized information
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials, colours, and other information are accurate. However, slight variations may occur because of screen and device settings, material characteristics, handmade or manufacturing processes, natural variation in materials, photography and lighting, or production tolerances. Such variations do not necessarily constitute a defect.
4. Product Availability
Products may be added, modified, discontinued, or become unavailable without notice. We reserve the right to limit quantities or refuse an order where reasonably necessary.
5. Personalization
Customers are responsible for providing accurate personalization information. This includes names, addresses, numbers, dates, artwork, logos, messages, measurements, and other information submitted with an order. Varmyra is not responsible for errors resulting from incorrect information supplied by the customer.
6. Custom Projects
Custom projects may require additional communication, design approval, specifications, measurements, artwork, or other information before production. Once a custom project enters production, changes or cancellations may not be possible. Custom projects are generally non-returnable once production has begun, except where required by applicable law or where the product is defective or Varmyra has made an error.
7. Pricing
All prices displayed by Varmyra are in Canadian dollars unless otherwise stated. We reserve the right to correct pricing errors. If an obvious pricing error occurs, we may contact you before fulfilling the order and provide the option to confirm the corrected price or cancel the order.
8. Orders and Payment
An order is not considered accepted until Varmyra has received payment and accepted the order. We reserve the right to refuse or cancel an order where reasonably necessary, including where there is an obvious pricing error, suspected fraud, inventory issue, or inability to fulfill the order.
9. Production Times
Many Varmyra products are made to order. Estimated production times are provided as guidance and are not guaranteed unless expressly stated otherwise. Production may be affected by order volume, personalization requirements, material availability, design approvals, or circumstances outside our reasonable control.
10. Shipping
Varmyra currently ships to customers in Canada. Shipping times are estimates and may be affected by carrier delays, weather, holidays, incorrect addresses, remote delivery conditions, or other circumstances outside Varmyra's control. Customers are responsible for providing an accurate shipping address. Additional details are provided in our Shipping Policy.
11. Returns and Refunds
Returns and refunds are governed by our Return & Refund Policy. Personalized, customized, engraved, and made-to-order products are generally not eligible for return due to a change of mind. Nothing in these Terms limits rights that cannot legally be excluded.
12. Intellectual Property
All content on the Varmyra website, including logos, branding, photographs, graphics, product descriptions, designs, text, and other materials, is owned by or licensed to Varmyra unless otherwise stated. You may not reproduce, distribute, modify, sell, or commercially exploit Varmyra content without prior written permission.
13. Customer-Submitted Content
If you provide artwork, photographs, logos, text, or other content for a custom project, you represent that you have the right to provide and use that content. You grant Varmyra permission to use submitted content solely as reasonably necessary to fulfill your order or provide the requested service. Varmyra will not knowingly use customer-submitted personal or proprietary content for unrelated marketing purposes without appropriate permission.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Varmyra will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from the use of our website or products. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
15. Force Majeure
Varmyra is not responsible for delays or inability to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, transportation disruptions, supply shortages, utility failures, labour disruptions, government actions, technology failures, or other events beyond our reasonable control.
16. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. Any dispute will be subject to the applicable jurisdiction of Ontario, Canada, except where applicable consumer-protection law provides otherwise.
